New FTC Guidelines for Bloggers, Others

Today — December 1 — new Federal Trade Commission guidelines for endorsements and testimonials went into effect — guidelines that apply to bloggers and others who endorse products and get paid for it, ie through affiliate links. The guidelines are broad but it’s basically all about disclosure and being honest. While officially you should seek your own counsel, here is a link that lists a variety of reactions and opinions to the guidelines. Our opinion — and it’s just an non-legal opinion of course — is that if you practice disclosure and you’re honest about why you are recommending a product, you won’t be a target. You gotta admire Huff Post for the eye-catching headlines, like this one. The Huffington Post, a liberal blog and news site, was launched in 2005 and now has 22 million unique visitors a month and is the most linked-to blog on the internet. While Megan Fox, her panties, and photos of both are not the typical content of Huff Post, this is an example of how a blog can build its breadth and expand its audience (yes we’re serious and having serious fun writing this). Never underestimate the power of an eye-catching headline in your blog or other site — especially when it gets linked like this

South Korea Goes After Blogger; And in Iran, Blogger Dead

It’s getting to be a dangerous world out there for bloggers. A South Korean blogger who was arrested in January faces up to 18-months in jail. A verdict is expected April 20th. The blogger — known as “Minerva” — has been a fierce critic of that country’s economic policies. He became famous after several of his predictions came true, including the collapse of Lehman Brothers. Full story here.

In Iran, where blogging has become a major outlet of opinion and dissent, a blogger has died in prison, after being jailed for violating what the regime had called crimes against Islamic law.

Both are good, but our buddy has already been using Wordpress — he knows it, he loves it, so why change. Also, instead of paying the monthly Yahoo and Amazon fees, you download the Market Theme for a one-time license fee of $55 (or a $150 fee for a developer license).

So if you already use Wordpress, this is a no-brainer. If you haven’t tried Wordpress before, we highly recommend you start, for just about all your internet entrepreneurial needs.

One of us just finished the biography of Hugh Hefner, Mr Playboy: Hugh Hefner and the American Dream. The key take-way — that kept coming back again and again – is that, Hefner was not only the Editor and Publisher — he was also the demographic. In other words, he was putting together a magazine that HE would want to read. In MORE other words, he built a business that he was passionate about. And THAT is the key to success. Look at McDonald’s: Ray Kroc was not passionate about hamburgers; he was passionate about franchising, and one of his executives was passionate about real estate — the result: a $40 billion business.

What we’re saying is, you need to build a business around something you are passionate about. “Naked girls, sounds good!” Yes, grasshoppers, but look at the situation, Hefner saw the opportunity in 1953 — in a world of Esquire-type mags — for nudity, in a cool, sophisticated way. He wrote a whole Playboy philosophy about it. So what are you passionate about? Yes, it can be sexual, but what opportunity can you find today, in 2009? If you blog about your passion — or if you build an e-retail site about your passion — you are automatically WAY AHEAD of your competition, if they are just thinking of it as a way to make bucks. You will eventually make more bucks because you will attract those who have the same passion as you. You will have no problem blogging about your topic late at night, after work (or adding another product to your online store) because you like – love – doing it, just like your readers/customers love it.

Expertise — and eventual success — is simply, ultimately, the result of passion.

Let’s say your goal is to get 10,000 unique visitors to your website every day. Is it best to have one website, and concentrate all your efforts on that one website to get those 10,000 visitors? Or is it better to have two websites, with the goal of 5,000 visitors each; is that less work overall than 10,000 for one site?… OR how about having five websites? Surely grabbing 2,000 visitors per site is almost automatic — that would give you your 10,000 total. OORR what if you had five websites that each did just 3,000 — suddenly you’ve got 15,000 instead of 10,000… Welcome to our new segment, WE’RE JUST ASKING. Sometimes it’s important to simply ask the question… You may assume one way is the most profitable…but is it?

The Financial Times is reporting:

“Revised guidelines on endorsements and testimonials by the Federal Trade Commission, now under review and expected to be adopted, would hold companies liable for untruthful statements made by bloggers and users of social networking sites who receive samples of their products.”

“If a blogger received a free sample of skin lotion and then incorrectly claimed the product cured eczema, the FTC could sue the company for making false or unsubstantiated statements. The blogger could be sued for making false representations.”

Wordpress: Making Other Websites Obsolete

Ok, this might still be an opinion at the moment, but we are beginning to think that Wordpress, the free open-source blog program, is making other website-building options, or the need for those options, nearly obsolete. First of all, as you may already know from previous posts, we consider Wordpress to be the best blogging software. It’s not that the others are bad; some have advantages that Wordpress does not. But with Wordpress — and its endless supply of themes, plug-ins, and widgets — you can pretty-much do anything: it’s not your dad’s blog anymore. With the right themes and the necessary plug-ins and widgets, your “blog” can look like, and operate as, just about any kind of site. Wordpress is part of the so-called Web 2.0 world we recently referred to here – the user-generated software is always evolving and improving.
